Louisiana’s DWI Laws
It is illegal to operate a motor vehicle in Louisiana with a blood alcohol content (BAC) of .08 or higher. If the court finds you guilty, the DWI penalties are severe:
- First DWI offense: A misdemeanor offense that carries a fine of $300 to $1,000 and up to six months of jail time.
- Second DWI offense: A misdemeanor offense with a fine of $750 to $1,000, suspended driving privileges for up to two years, and up to six months of jail time with a minimum of 48 hours in jail.
- Third DWI offense: A felony offense with one to five years of jail time, up to $2,000 in fines and a suspended license for up to three years.
- Fourth or subsequent DWI offense: A fourth or subsequent felony offense of DWI requires a mandatory fine of $5,000 and jail time of 10 to 30 years, with 2 years of the sentence being without benefits of probation or suspension of sentence.
What happens if I’m arrested? It’s very important to remember that if you are arrested for DWI or another alcohol-related offense in Louisiana, charges don’t immediately go on your record. It takes time for police to file a report — time we use to carefully review the details of your case and work with law enforcement to keep charges from ever appearing on your record.
